1An Act to create 100.75 of the statutes;
relating to: requiring retail sellers to
2accept cash and providing a penalty.

This bill requires a retailer who sells goods or services from a physical location
to accept cash as payment in a transaction amounting to $2,000 or less during a
face-to-face sale with a consumer, unless the person is otherwise prohibited by law
from accepting cash. A retailer who violates this requirement is subject to a civil
forfeiture of $200 to $5,000.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 100.75 of the statutes is created to read:

4100.75 Retail sellers required to accept cash. A person who sells goods or
5services at retail from a physical location may not refuse to accept cash in exchange
6for those goods or services if the transaction amounts to $2,000 or less and is a
7face-to-face sale with a consumer, unless the person is otherwise prohibited by law
1from accepting cash for the goods or services being sold. The department, or any
2district attorney upon notifying the department, may commence an action in the
3name of the state to recover a forfeiture to the state of not less than $200 and not more
4than $5,000 for each violation of this section. In lieu of or in addition to a forfeiture,
5the department, or any district attorney upon notifying the department, may seek
6a temporary or permanent injunction restraining any person from violating this
7section.
