AB1117,1,2 1An Act to create 283.56 of the statutes; relating to: requiring fencing and
2signage at retention ponds.
Analysis by the Legislative Reference Bureau
Under current law, the Department of Natural Resources issues WPDES
(water pollutant discharge elimination system) permits and stormwater discharge
permits. This bill requires a person who, as part of the person's activities under such
a permit, creates a retention pond to install and maintain a fence around the
perimeter of the retention pond and install signage that identifies the presence of the
retention pond and warns of the dangers of entering the pond.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB1117,1 3Section 1. 283.56 of the statutes is created to read:
AB1117,2,2 4283.56 Fencing and signage of retention ponds. (1) In this section,
5“retention pond” means a temporary or permanent artificial water body designed to
6reduce the water quantity or water quality impacts of water received from a person
7holding a permit under this chapter for any period of time. “Retention pond” includes

1an absorption, detention, storage, stormwater management, or treatment pond or
2lagoon.
AB1117,2,5 3(2) Any person who is required to obtain a permit under this chapter and who,
4as part of the activities covered under the permit, creates or causes to be created a
5retention pond shall, as a condition of that permit, do all of the following:
AB1117,2,76 (a) Install and maintain fencing around the perimeter of the retention pond
7that is designed to keep individuals from entering the retention pond.
AB1117,2,108 (b) Install and maintain signage at the retention pond that clearly identifies
9the presence of the retention pond and notifies individuals of the dangers of entering
10the retention pond.
