AB1024,1,2 1An Act to create 118.16 (2) (cg) 2m. of the statutes; relating to: notice to the
2parent or guardian of a habitually truant child.

Under this bill, a school attendance officer must include in the notice provided
to the parent or guardian of a child who is habitually truant, which means the child
has been absent without an excuse for part or all of five or more days during a school
semester, that the parent or guardian may request an evaluation of whether the child
is a child with a disability or, for a child who has been identified as a child with a
disability and for whom an individualized education program has been prepared, a
review of the IEP and, if appropriate, revision of the child's IEP. Under current law,
a school attendance officer must provide a notice to the parent or guardian of a child
who is habitually truant that includes 1) a statement of the parent's or guardian's
responsibility to have the child to attend school regularly; 2) a statement that the
parent or guardian may request certain program or curriculum modifications and
that the child may be eligible for enrollment in a program for children at risk; 3) a
request that the parent or guardian meet with the school to discuss the child's
truancy; and 4) a statement of the penalties that may be imposed on the parent or
guardian if the parent or guardian fails to have the child to attend school regularly.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB1024,2,32 118.16 (2) (cg) 2m. A statement that the parent or guardian may request any
3of the following:
AB1024,2,54 a. A referral under s. 115.777 for an evaluation of whether the child is a child
5with a disability, as defined under s. 115.76 (5).
AB1024,2,66 b. A copy of the information described under s. 115.777 (3) (d).
AB1024,2,117 c. For a child who has been identified as a child with a disability, as defined
8under s. 115.76 (5), and for whom an individualized education program under s.
9115.787 is in effect, a meeting of the child's individualized education program team
10to review and, if appropriate, revise that individualized education program as
11provided under s. 115.787 (4).
