SB630,1,3 1An Act to create 49.471 (6) (bm) of the statutes; relating to: extension of
2BadgerCare Plus benefits to certain postpartum women and making an
3appropriation.
Analysis by the Legislative Reference Bureau
Under this bill, postpartum women who begin receiving substance
abuse-related health services under BadgerCare Plus while pregnant remain
eligible for Medical Assistance program benefits through BadgerCare Plus for
approximately one year after the last day of the pregnancy, subject to approval by the
federal government. This eligibility extension occurs without regard to any changes
in the woman's family income. Currently, all postpartum women who are eligible for
BadgerCare Plus while pregnant are eligible for BadgerCare Plus benefits for two
to three months after the last day of the pregnancy, depending on what day of the
month that occurs.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB630,1 4Section 1. 49.471 (6) (bm) of the statutes is created to read:

149.471 (6) (bm) 1. Notwithstanding par. (b) and subject to subd. 2., a pregnant
2woman who is determined to be eligible for benefits under sub. (4) and who receives
3substance abuse-related health services under the Medical Assistance program
4while pregnant remains eligible for benefits under sub. (4) for the balance of the
5pregnancy and to the last day of the month in which the date that is one year after
6the last day of the pregnancy falls without regard to any change in the woman's
7family income.
SB630,2,158 2. The department shall submit to the federal department of health and human
9services any request for a waiver or state plan amendment necessary to implement
10subd. 1. If approval by the federal department of health and human services is not
11necessary or if the federal department of health and human services does not
12disapprove the request, the department shall implement subd. 1. on a date
13determined by the department. The department may not implement subd. 1. if the
14federal department of health and human services disapproves the request for a
15waiver or state plan amendment.
SB630,2 16Section 2 . Fiscal changes.
SB630,2,2017 (1) Extension of postpartum benefits. In the schedule under s. 20.005 (3) for
18the appropriation to the department of health services under s. 20.435 (4) (b), the
19dollar amount for fiscal year 2020-21 is increased by $332,900 to extend benefits to
20postpartum women under s. 49.471 (6) (bm).
