Analysis by the Legislative Reference Bureau
This bill is explained in the Notes provided by the Joint Legislative Council in
the bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Joint Legislative Council prefatory note: This bill was prepared for the Joint
Legislative Council's Study Committee on Child Placement and Support.
Under current law, a court must set a physical placement schedule that allows a
child to have regularly occurring, meaningful periods of physical placement and that
maximizes the amount of time for a child with each parent. The bill adds a statement
among the general provisions for custody and placement that any allocation of physical
placement, as ordered by the court, presumes that the involvement and cooperation of
both parents regarding the physical, mental, and emotional well-being of the child is in
the best interest of the child.
AB97,1 3Section 1. 767.41 (1) (c) of the statutes is created to read:
AB97,2,24 767.41 (1) (c) Any allocation of physical placement, as ordered by the court,
5presumes that the involvement and cooperation of both parents regarding the

1physical, mental, and emotional well-being of the child is in the best interest of the
2child.
