AB804,1,2 1An Act to create 940.45 (7) of the statutes; relating to: intimidating a victim
2of domestic abuse and providing a penalty.
Analysis by the Legislative Reference Bureau
Under current law, the crime of intimidating a crime victim is a Class A
misdemeanor unless there are aggravating circumstances that increase the penalty
to a Class G felony. Under this bill, the crime of intimidating a victim of a crime of
domestic abuse is a Class G felony.
Because this bill creates a new crime or revises a penalty for an existing crime,
the Joint Review Committee on Criminal Penalties may be requested to prepare a
report.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB804,1 3Section 1. 940.45 (7) of the statutes is created to read:
AB804,1,64 940.45 (7) Where the underlying crime is an act of domestic abuse, as defined
5in s. 968.075 (1) (a), that constitutes the commission of a crime or a crime that,
6following a conviction, is subject to the surcharge in s. 973.055.
