AB6,1,4 1An Act to amend 29.063 (3) (intro.); and to create 29.063 (3m) of the statutes;
2relating to: the handling of deer carcasses in the field, the transport of deer
3carcasses, and the suspension of portions of emergency rules of the Department
4of Natural Resources.
Analysis by the Legislative Reference Bureau
Current law authorizes the Department of Natural Resources, in order to
control chronic wasting disease, to promulgate rules regulating the transportation,
possession, control, storage, or disposal of the carcass of a cervid, which is any species
of deer or elk that is present in the wild and that is not a farm-raised deer. Under
this bill, DNR may not prohibit the transportation of a deer carcass out of the county
in which it was harvested. Also under the bill, DNR must require that all parts of
a deer carcass be removed from the field, except for entrails.
This bill is introduced as required by s. 227.26 (2) (f), stats., in support of the
action of the Joint Committee for Review of Administrative Rules in suspending
portions of section NR 10.105, Wis. Adm. Code, emergency rules of the Department
of Natural Resources on October 1, 2018. The suspended portions of the rules
eliminated restrictions on dividing a deer carcass in the field and a prohibition on
leaving any part of a deer carcass in the field and generally prohibited a deer carcass

harvested in a chronic wasting disease affected area from being transported outside
of the county of harvest.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB6,1 1Section 1. 29.063 (3) (intro.) of the statutes is amended to read:
AB6,2,52 29.063 (3) (intro.) To control chronic wasting disease, the department may,
3subject to sub. (3m),
promulgate rules regulating the transportation, possession,
4control, storage, or disposal of the carcass of a cervid in this state, except that the
5rules may not apply to any of the following:
AB6,2 6Section 2. 29.063 (3m) of the statutes is created to read:
AB6,2,87 29.063 (3m) (a) The department may not prohibit the transportation of the
8carcass of a deer out of the county in which it was harvested.
AB6,2,109 (b) The department shall require that all parts of a deer carcass be removed
10from the field, except that entrails may be disposed of in the field.
