AB276,1,2 1An Act to create 84.06 (14) of the statutes; relating to: water quality
2management in state highway projects.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Transportation, in its specifications for
highway improvements, to encourage the proposal of alternate water quality
management plans from those provided in DOT's specifications. The bill also
provides that DOT may not reject a bid based on the bidder's proposed use of an
alternate water quality management plan if the proposed plan will result in water
quality performance at least as good as would be achieved under DOT's specifications
and at no greater cost than would be achieved under DOT's specifications.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB276,1 3Section 1. 84.06 (14) of the statutes is created to read:
AB276,2,24 84.06 (14) Water quality management. (a) In this subsection, “water quality
5management plan” means a plan for the management of storm water and drainage

1during construction of a highway improvement, after construction of the
2improvement during the operative life of the improvement, or both.
AB276,2,63 (b) All specifications for highway improvements prepared by the department
4for improvements within its jurisdiction shall include an encouragement to propose,
5for use in the improvement, an alternate water quality management plan from that
6provided in the specification.
AB276,2,127 (c) Notwithstanding s. 85.19, the department may not reject a bid under sub.
8(2) based on the bidder's proposed use of an alternate water quality management
9plan from that provided in the highway improvement specification if the proposed
10plan will result in water quality performance at least as good as would be achieved
11under the plan provided in the specification and at no greater cost than would be
12achieved under the plan provided in the specification.
