SB31,1,3 1An Act to consolidate, renumber and amend 283.31 (8) (a), (b), (c); and to

20.370 (4) (mi) of the statutes; relating to: permit fees for concentrated
3animal feeding operations.
Analysis by the Legislative Reference Bureau
Under current law, a concentrated animal feeding operation (CAFO) that holds
a water pollutant discharge elimination system (WPDES) permit from the
Department of Natural Resources must pay an annual permit fee of $345. Of that
amount, $95 is deposited into an appropriation account for DNR's environmental
quality functions and its management of state water resources, with the remainder
deposited into the general fund.
Under this bill, the full amount of the $345 annual WPDES permit fee for a
CAFO is deposited into the DNR appropriation account for environmental quality
functions and management of state water resources.

an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB31,1 4Section 1. 20.370 (4) (mi) of the statutes is amended to read:

120.370 (4) (mi) General program operations — private and public sources.
2From the general fund, all moneys not otherwise appropriated that are received from
3private or public sources, other than state agencies and the federal government, for
4facilities, materials, or services provided by the department relating to its
5environmental quality functions and to the management of the state's water
6resources and all moneys required under s. 283.31 (8) (b) to be credited to this
7appropriation to pay for expenses associated with those facilities, materials, or
8services.
SB31,2 9Section 2. 283.31 (8) (a), (b) and (c) of the statutes are consolidated,
10renumbered 283.31 (8) and amended to read:
SB31,2,1811 283.31 (8) The holder of a permit under this section for a concentrated animal
12feeding operation shall annually pay to the department a fee of $345 . (b) Of each
13fee paid under par. (a), $95
, which shall be credited to the appropriation account
14under s. 20.370 (4) (mi). (c) The department shall annually submit a report to the
15joint committee on finance and, under s. 13.172 (3), to the standing committees of the
16legislature with jurisdiction over agricultural and environmental matters describing
17the use of the moneys credited to the appropriation account under s. 20.370 (4) (mi)
18under par. (b) this subsection.
