49.46 (2) (bh) of the statutes is created to read:
(bh) Benefits provided under par. (b) shall include inpatient and 8
outpatient care provided to evaluate, diagnose, and treat a mental health condition 9
or substance use disorder, including behavioral health treatment such as 10
psychotherapy and counseling, mental and behavioral health inpatient services, and 11
treatment of a substance use disorder.”.
609.716 of the statutes is created to read:

Defined network plans and preferred provider plans are 4
subject to s. 632.895 (14d).
632.895 (14d) of the statutes is created to read:
632.895 (14d) Mental health services and substance abuse treatment.
disability insurance policy and every self-insured health plan of the state or of a 8
county, city, town, village, or school district shall provide coverage for inpatient and 9
outpatient care provided to evaluate, diagnose, and treat a mental health condition 10
or substance use disorder, including behavioral health treatment, such as 11
psychotherapy and counseling, mental and behavioral health inpatient services, and 12
substance use disorder treatment. Coverage required under this subsection includes 13
coverage for preexisting mental health conditions and substance use disorders an 14
individual has before the first date of coverage by the policy or plan. Mental health 15
parity and cost-sharing equity requirements in s. 632.89 (2) and (3) apply to the 16
coverage required under this subsection.”.
(1) Insurance coverage for mental health and substance abuse treatment.
(a) For policies and plans containing provisions inconsistent with this act, the 21
treatment of sections 609.716 and 632.895 (14d) of the statutes first applies to policy 22
or plan years beginning on January 1 of the year following the year in which this 23
paragraph takes effect, except as provided in paragraph (b).
(b) For policies and plans that are affected by a collective bargaining agreement 2
containing provisions inconsistent with this act, the treatment of sections 609.716 3
and 632.895 (14d) of the statutes first applies to policy or plan years beginning on the 4
effective date of this paragraph or on the day on which the collective bargaining 5
agreement is newly established, extended, modified, or renewed, whichever is later.
This act takes effect on the day after publication, 7
except as follows:
8(1) Insurance coverage for mental health and substance abuse treatment.
The treatment of sections 609.716 and 632.895 (14d) of the statutes and Section
of this act take effect on the first day of the 4th month beginning after publication.”.
