This bill eliminates a rule promulgated by the Department of Natural
Resources, relating to construction permit requirements for stationary sources that
emit greenhouse gases, which is no longer valid under the Supreme Court's decision
in Utility Air Regulatory Group v. EPA, 573 U.S. ___ (2014).
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
NR 405.07 (9) (a) (intro.) and NR 405.07 (9) (a) 1. (intro.) of the 4
administrative code are consolidated, renumbered NR 405.07 (9) (a) (intro.) and 5
amended to read:

(a) (intro.) Emissions
Beginning January 2, 2011, emissions
greenhouse gases at a stationary source shall only be subject to regulation under the 8
Act as follows: 1. Beginning January 2, 2011,
if the stationary source is any of the 9
NR 405.07 (9) (a) 1. a. of the administrative code is renumbered NR 2
405.07 (9) (a) 1m.
NR 405.07 (9) (a) 1. b. of the administrative code is renumbered 4
405.07 (9) (a) 2m.
NR 405.07 (9) (a) 2. of the administrative code is repealed.
